Federal Tax Obligations for California LLCs
California LLC members have the same federal obligations as LLCs everywhere — but the combined federal + California burden is among the highest in the country. Federal taxes sit on top of CA's 13.3% state tax + $800 franchise tax + potential LLC fee. For state taxes, see our CA LLC tax guide.
Default Federal Classification
Single-member LLC: Disregarded entity — Schedule C (Form 1040). Subject to self-employment tax (15.3%).
Multi-member LLC: Partnership — Form 1065 + K-1s. Each member reports on personal return.
S-corp election (Form 2553): File Form 1120-S. Salary subject to payroll taxes; distributions are not.
California + Federal Combined Burden
For a single California LLC member earning $200K net profit:
| Tax | Amount |
|---|---|
| Federal income tax (~24% effective) | ~$36,000 |
| Self-employment tax | ~$26,500 |
| California state income tax (~9.3%) | ~$14,000 |
| California franchise tax | $800 |
| Total | ~$77,300 (38.6% effective) |
With S-corp election ($100K salary):
| Tax | Amount |
|---|---|
| Federal income tax | ~$36,000 |
| Payroll taxes (salary only) | ~$15,300 |
| California income tax | ~$14,000 |
| California S-corp tax (1.5% net income) | ~$3,000 |
| Total | ~$68,300 |
| Savings | ~$9,000/year |
Note: California S-corps pay a 1.5% tax on net income (minimum $800) instead of the $800 flat franchise tax. For high-income LLCs, this can be MORE than $800.
FAQ
Ready to get started?
Get StartedDoes the QBI deduction help California LLC owners?
The federal 20% QBI deduction reduces federal tax only. California does NOT conform to the QBI deduction — you get no state-level benefit. Your CA taxable income is higher than federal taxable income because CA disallows this deduction.
Is the S-corp election worth it in California?
Yes for federal SE tax savings. But analyze the CA S-corp 1.5% net income tax carefully. If net profit exceeds ~$53,000, the CA S-corp tax ($800 minimum, then 1.5% of net income) may exceed the $800 flat LLC franchise tax. The federal SE savings usually outweigh this increase, but run the numbers.
